Data and documents, which can be made publicly available for reuse, and data and documents, which are protected on the grounds of commercial confidentiality, including business, professional and company secrets, statistical confidentiality, the protection of intellectual property rights of third parties or the protection of personal data, are often held by the same public sector bodies. Therefore, it is necessary to align definitions and common principles applying to all public sector information and address questions regarding the interplay of the two sets of rules.

Therefore, it is necessary to align definitions and common principles applying to all public sector information and address questions regarding the interplay of the two sets of rules. Such an approach helps to strike a balance between promoting transparency and the reuse of public sector information and the need to protect legitimate interests relating to confidentiality, intellectual property and data protection. In this way, public authorities can facilitate access to reusable data without compromising rights and interests protected by the applicable law, while also ensuring legal certainty and uniform application of the relevant rules.
