Member States may provide that, where AI systems are developed, tested, validated or deployed by competent authorities within the meaning of Directive (EU) 2016/680 for the prevention, detection, investigation or prosecution of criminal offences, such processing may be considered to pursue an important public interest, provided that appropriate safeguards under Union and national law apply.
