The transfer of data to a third country, or their processing by an entity subject to the jurisdiction of a third country, may expose those data to unilateral access, to disclosure obligations conflicting with Union law, or to unilateral suspension measures. Where the data concerned are high-value datasets, trade secrets, research data, health data or data originating from natural persons, such exposure may harm both the persons concerned and the economic security of the Union. Controllers and data holders should accordingly assess the risks associated with such transfers, and implement appropriate technical, organisational and contractual safeguards. Those criteria are independent of the place of establishment of the entity concerned.
